Please read these Terms and Conditions carefully before making a reservation or using any equipment provided by HIVE PaddleSports (“HIVE,” “we,” “us,” or “our”). By completing a booking through our platform, you confirm that you have read, understood, and agree to be bound by these Terms.
1. Reservations & Booking
All reservations are made through the HIVE booking platform (EDDY) at hivepaddlesports.com or via our kiosk locations. Rentals are available in one-hour increments on the hour (e.g., 9:00 AM, 10:00 AM). Availability is not guaranteed until your reservation is confirmed and payment is processed.
Your access code (AlgoPIN) for equipment retrieval will be delivered via SMS after the cancellation window has passed. Do not attempt to access equipment prior to your reserved start time.
2. Payment & Fees
All payments are processed securely through our payment processor. By completing a reservation, you authorize HIVE to charge the applicable rental fee and place a hold on your payment method for the security deposit amount listed at checkout.
- Rental Fee: Charged at time of booking.
- Security Deposit: An authorization hold is placed on your payment method at the time of booking. This is not a charge — funds are held and released upon successful return of equipment in satisfactory condition. HIVE reserves the right to capture all or part of the security deposit in the event of damage, loss, or late return.
- Overage Charges: Returning equipment after your reserved end time may result in additional charges. A 30-minute buffer exists between bookings. Customers who return late and impact a subsequent reservation may be charged for the additional time at the standard hourly rate.
3. Cancellation Policy
- Cancellation 48+ hours before reservation: Full refund of rental fee. Security deposit hold released.
- Cancellation within 48 hours of reservation: No refund of rental fee. Security deposit hold released.
- No-show: No refund. Security deposit hold released after the reservation window closes.
To cancel, log in to your booking confirmation or contact us at [email protected]. Cancellations must be submitted through the platform to be valid.
4. Age Requirements & Minor Participants
The minimum age to rent and operate HIVE equipment is 12 years old. Participants under 18 must have a parent or legal guardian present who is willing to sign a separate Guardian Waiver on their behalf prior to equipment use.
- The maximum adult-to-minor ratio is 1 adult per 4 minors. Reservations that exceed this ratio will not be permitted.
- A supervising adult must be on the water or in immediate proximity at all times when minors are using equipment.
- Guardians assume full responsibility for the safety and conduct of all minors in their party.
HIVE reserves the right to refuse service if age or ratio requirements cannot be verified or are not met.
5. Safety Requirements
All participants must comply with applicable federal, state, and local safety regulations, including U.S. Coast Guard requirements for personal flotation devices (PFDs).
- Properly fitting PFDs are required for all participants under 13 and strongly recommended for all others.
- PFD availability and sizing guidance is provided at each kiosk location. See our PFD Safety page for full requirements.
- Participants assume full responsibility for wearing and properly securing PFDs during use.
In the event of an emergency, call 911 immediately. HIVE customer support is available by email and is not an emergency service. Do not rely on HIVE support for urgent or life-safety situations.
6. Waiver & Assumption of Risk
A separate Liability Waiver and Release of Claims must be signed by all participants (or their legal guardian, for minors) prior to equipment use. The waiver is electronically presented as part of the booking and check-in process. By proceeding with equipment access, you confirm that a valid, signed waiver is on file for all members of your party.
Paddleboarding, kayaking, and related water activities involve inherent risks including but not limited to: drowning, capsizing, collision, weather-related hazards, and physical injury. By renting equipment from HIVE, you acknowledge these risks and voluntarily choose to participate.
7. Equipment Use & Condition
Equipment is provided in good working condition. You are responsible for:
- Inspecting equipment before use and reporting any pre-existing damage via the return/check-in process or by contacting support.
- Returning equipment to the designated location by the end of your reservation window.
- Returning equipment in the same condition as received, normal wear and tear excepted.
- Any damage, loss, or theft of equipment during your rental period. Repair or replacement costs may be charged up to the full value of the equipment.
Do not modify, disassemble, or use equipment in a manner inconsistent with its intended purpose. Use is limited to designated water access areas.
8. Late Returns
All rentals must be returned to the designated location by the end of your reserved time slot. Late returns that impact subsequent reservations may result in additional hourly charges and may affect your ability to book with HIVE in the future. HIVE enforces a 30-minute buffer between back-to-back reservations to allow for safe returns.
9. Prohibited Uses
The following are strictly prohibited:
- Use of equipment while under the influence of alcohol, drugs, or any substance that impairs judgment or physical ability.
- Allowing anyone other than the registered renter or disclosed party members to use rented equipment.
- Use of equipment outside designated areas or in unsafe conditions (e.g., during active storm warnings, flood advisories, or high wind alerts).
- Commercial use of rented equipment without prior written authorization from HIVE.
HIVE reserves the right to revoke access and forfeit any rental fees paid if prohibited use is discovered.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HIVE PADDLESPORTS, ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF HIVE EQUIPMENT OR SERVICES, INCLUDING PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE.
Our total liability to you for any claim arising under these Terms shall not exceed the amount you paid for the specific rental giving rise to the claim.
11. Weather & Conditions
HIVE may issue weather alerts via SMS on the day of your booking. You are responsible for evaluating conditions and making safe decisions about participation. HIVE does not guarantee refunds for self-elected cancellations due to weather unless an official emergency or advisory has been issued by a government authority that directly impacts the rental location.
12. Privacy & Data
By creating a reservation, you consent to the collection and use of your personal information as described in our Privacy Policy. We collect information necessary to process your booking, deliver your access code, send booking-related communications, and maintain safety records. We do not sell your personal data to third parties.
Photo identification may be required for certain reservations, including those involving minors. Identification data is used solely for verification purposes and is not stored on HIVE servers.
13. Modifications to Terms
HIVE reserves the right to update or modify these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of HIVE services following any update constitutes acceptance of the revised Terms. We encourage you to review this page periodically.
14. Governing Law & Disputes
These Terms shall be governed by and construed in accordance with the laws of the State of [STATE — confirm with attorney], without regard to its conflict of law provisions.
